MBH: Legal Victory for Nogoom Football Club in Annulment Case 

In a recent annulment case filed by Ismaili Sporting Club (“ISC”) before the Cairo Court of Appeal (“CCA”), Matouk Bassiouny & Hennawy (“MBH”) Arbitration Department successfully defended an EGP 47 million Award from the Court of Arbitration for Sport (“CAS”) in favor of Nogoom Football Club (“NFC”) and the Egyptian Football Association (“EFA”).  

The CCA’s ruling affirmed that Egyptian courts lack jurisdiction to decide on arbitral awards issued by CAS unless the parties have explicitly agreed to the application of Egyptian Arbitration Law. It is noteworthy that the Arbitration Department has recently achieved a further victory in the form of sporting sanctions imposed by the EFA’s Disciplinary and Appeals committees against ISC for failing to enforce the CAS Award.  

The sanctions levied against ISC include a 3-point deduction in the 2020/2021 season, a transfer ban, and playing five matches without fans outside its home stadium in the current season of 2022/2023.
